Description

The seminar reviews how to handle European patent applications having clarity, unity and sufficiency of disclosure issues at the search and examination stage. The course refreshes, deepens and consolidates the strategies and the legal background to apply for dealing with highly complicated cases leading to lack of clarity, unity and/or sufficiency of disclosure objections. The harmonisation of practice at the national offices - and the relevant legal differences - are also considered. An overview of the EPO case law on clarity, unity and/or sufficiency of disclosure objections is also given. Practical examples will be discussed in the fields of engineering (physics/electricity/mechanics) and non-engineering (biology/pharma/chemistry).

Prerequisites

 

Participants must have a minimum of 4 years of search and examination experience.  The participants will preferably have already attended the corresponding last year's intermediate level seminar OS11-2013. The present course can preferentially be combined with one of OS14-2014 (novelty and inventive step - intermediate level) or OS15-2014 (novelty and inventive step - advanced level), which take place right after OS12-2014.

A good command of English, both orally and in writing is expected.
