Description

This seminar focuses on improving the participants' basic skills in assessing novelty and inventive step. After a short review of the basics of novelty and inventive step assessment - including feature analysis of the claims and the prior art, priority and intermediate documents issues, and the problem-solution approach - the participants will receive lectures about special cases related to novelty and inventive step, such as partial problems, alternative solutions, implicit features, selection inventions, and juxtaposition/aggregation of features. The lectures will be supplemented by practical case studies and exercises which will provide enhanced hands-on experience to the participants in the assessment of novelty and inventive step. The exercises will have a particular focus on the application of the problem-solution approach. Furthermore, participants will have the opportunity to discuss the cases and related topics with EPO experts during the practical exercises as well as in plenary sessions. The seminar takes into account the different technical areas of engineering (physics/electricity/mechanics) and non-engineering (biology/pharma/chemistry).

Prerequisites

Participants must have attended the entry level course OS09-2013 or OS09-2014, and/or must have a minimum of 2 years of patent examination experience. The present course can preferentially be combined with one of OS11-2014 (clarity and unity - intermediate level) or OS12-2014 (clarity and unity - advanced level) which take place right before OS14-2014.

Furthermore, a good command of English, both orally and in writing, is expected.
